Settlement Status

The Court has preliminarily approved the Settlement. The Court will hold a "Fairness Hearing" on August 12, 2025 at 9:30 A.M. to consider the Settlement.

If you are eligible and the Court approves the Settlement, you will receive a portion of the Net Settlement Fund on a pro rata basis. The relief provided to the Settlement Class will be provided only if the Court gives final approval to the Settlement and, if there are any appeals, after the appeals are resolved in favor of the Settlement.

What is this Settlement about?

Allan Herdemian filed a lawsuit in 2017 claiming that GO WIRELESS violated its commission agreements and certain laws regarding the payment of worker sales commissions.

The lawsuit alleges that GO WIRELESS violated its commission agreements with employees who worked as wireless consultants, assistant store managers, store managers and other positions earning commissions from sales in retail stores.

GO WIRELESS denies that it did anything wrong and contends Mr. Herdemian received all the commissions to which he was entitled. In February 2025, the parties agreed to settle to avoid the cost and risk of continuing the case in court.

Who is included?

You are a member of the Settlement Class if:

You worked for GO WIRELESS as a wireless consultant, assistant store manager, store manager, or other position that received compensation via commissions from sales in retail locations at any time from May 2014 through July 2019.

How do I participate in the Settlement?

To receive a payment, you must verify your identity by July 10, 2025.

If you do nothing, you will receive no payment from the settlement, and your rights will be affected.

If you wish to receive money, you must verify your identity with the Settlement Administrator online or download a form at www.GWClassAction.com and mail it to the Settlement Administrator.

The Court in charge of this case still has to decide whether to approve the Settlement. Payments will be made if the Court approves the Settlement and after any appeals are resolved. Please be patient.

  • If you verify your identity and the Court approves the Settlement, you will receive a portion of the Net Settlement Fund.

Deadline: June 10, 2025

  • Challenge the Settlement.
  • You may file a written objection telling the Court why you object to the Settlement and think it should not be approved.
  • Submitting an objection does not exclude you from the Settlement.

DO NOTHING

No Deadline

  • Get no payment from the settlement.
  • Give up rights resolved by settlement.
  • You will still be bound by the settlement and its "release" provisions.

ATTEND THE HEARING

August 12, 2025 at 9:30 A.M.

  • Go to Court.
  • The Court will hold a "Fairness Hearing" to consider the Settlement, the request for attorneys' fees and costs, and the Plaintiffs' request for Service Awards.
  • You may, but are not required to, speak at the Fairness Hearing about any objection you filed to the Settlement.
  • If you intend to speak at the Fairness Hearing, you must also submit a "Notice of Intention to Appear" indicating your intent to do so.
