Allan Herdemian filed a lawsuit in 2017 claiming that GO WIRELESS violated its commission agreements and certain laws regarding the payment of worker sales commissions. The lawsuit alleges that GO WIRELESS violated its commission agreements with employees who worked as wireless consultants, assistant store managers, store managers and other positions earning commissions from sales in retail stores.
GO WIRELESS denies that it did anything wrong and contends Mr. Herdemian received all the commissions to which he was entitled. No court has decided which side is right.
In February 2025, the parties agreed to settle, which means they have reached an agreement to resolve the lawsuit. Both sides want to avoid the cost and risk of continuing the case in court. The settlement is for the employees who brought the case and all members of the settlement class.
A class action is a lawsuit where one or more people called "Class Representatives" sue on behalf of people who have similar claims. All of these people together are the "Class" or "Class Members." In a class action, the court resolves the issues for all Class Members, except those who exclude themselves from the Class.
You are a member of the Settlement Class if you worked for GO WIRELESS as a wireless consultant, assistant store manager, store manager, or other position that received compensation via commissions from sales in retail locations at any time from May 2014 through July 2019.

Yes. As long as you worked for GO WIRELESS in a qualifying position between May 2014 and July 2019 and earned commissions, you may be eligible regardless of your current employment status.
GO WIRELESS has agreed to pay a total of $13,000,000.00 into a settlement fund. This money will be divided among the verified class members and will also be used to pay for litigation costs (up to $850,000) and lawyer fees (up to $5,200,000) if approved by the Court, and for the cost of administering this settlement (up to $175,000).

After your identity has been verified, you will be able to see your estimated settlement payment on the settlement website. Please note that the estimated settlement payment that you see on the website is higher than the amount you will receive because taxes/withholdings will be deducted.
A class member's share of the Net Settlement Amount will be the amount of each class member's estimated damages ("Individual Damages"), as calculated by Plaintiffs' expert, multiplied by the following fraction: the Net Settlement Amount divided by the amount of all class members' estimated damages ("Total Class Damages"), as calculated by Plaintiffs' expert, i.e., Individual Damages x (Net Settlement Amount ÷ Total Class Damages) = individual settlement payment.
If you wish to receive money, you must verify your identity with the Settlement Administrator online or download a form at www.GWClassAction.com and mail to the Settlement Administrator. The deadline for verifying your identity is July 10, 2025. Mailed notices must be postmarked by that date.
For class members who are current Victra employees, your identity is already verified, but you will still need to respond to the Settlement Administrator to receive a settlement payment.
No payments will be made unless and until the Court approves the settlement and appeals, if any, are resolved. The Court will hold a Fairness Hearing on August 12, 2025 to decide whether to approve the settlement. If the Court approves the settlement, there may be appeals. Resolving any appeals can take time. Please be patient.

You have three options:
If you do nothing, you will not get any money, but you will still be bound by the settlement and its "release" provisions. That means you won't be able to start, continue, or be part of any other lawsuit against GO WIRELESS about the claims/issues in this case.
If you disagree with any part of the settlement (including the lawyers' fees), you may object. You must give reasons why you think the Court should not approve the settlement and say whether your objection applies to just you, a part of the class, or the entire class.

Yes. The Court will hold a "Fairness Hearing" on August 12, 2025 at 9:30 a.m. at the Regional Justice Center, Courtroom 16C, 16th floor, 200 Lewis Avenue, Las Vegas, NV 89101.
You don't have to attend the hearing, but you may at your own expense. You may also ask the Court for permission to speak and express your opinion about the settlement. If you intend to speak at the Fairness Hearing, you must also submit a "Notice of Intention to Appear" indicating your intent to do so.

Lawyers' fees and costs will be paid from the settlement fund. You will not have to pay the lawyers directly.
To date, your lawyers have not been paid any money for their work or the expenses that they have paid for the case. To pay for their time and risk in bringing this case without any guarantee of payment unless they were successful, your lawyers will request that the Court approve a payment of up to $5,200,000 total in attorneys' fees plus the reimbursement of out-of-pocket expenses of up to $850,000.
